Village of Evendale
Board of Zoning Appeals
Minutes for the
April 19, 2006 Meeting
The Zoning Board of Appeals was called to order by Chairman Al Schutte at 7:30 P.M. on April 19, 2006 in the Council Library. Chairperson Al Schutte, members Tom Lippert, Lynn McCarthy, and Mike Reed were present. Member D. Lynn Watts was absent. Doug and Lee Walden, applicants, and Pam Morin, Building Department, were also present.
The following request was heard:
Douglas Walden, 3910 Glendale-Milford Road
Request for a variance to Section 1266.11(a)(6) of the Village of Evendale.
File #V-06-01
Doug & Lee Walden submitted plans for a chain link fence for their residence at 3910 Glendale-Milford Road. Don Mercer, Village of Evendale Building Commissioner, denied their request in accordance to Section 1266.11(a)(6), prohibiting chain link fences in the Residential District.
Mr. and Mrs. Walden watch their young grandchildren several times a week, and feel that they need a fence for their safety. They have requested a chain link fence, because four of the six neighboring houses and the Evendale Elementary school all have chain link fences. They want to blend into the neighborhood and feel any other fence would be out of place. The height of their fence would be the same height as the neighboring fences.
The committee discussed the six justifications for granting a variance. Mike Reed felt that #3 justification was met stating that since the surrounding fences were all chain link this made it an unique situation. The committee did not feel that justifications #1 and #5 were met.
Notification of the meeting was sent to all adjoining neighbors. There was no public response.
Tom Lippert made a motion to deny the request since all justifications were not met. Mike Reed seconded the motion. The motion passed with a vote of 4 – 0.
The minutes were read. Al Schutte made and Lynn McCarthy seconded the motion to approve the minutes as read.
The meeting was adjourned at 7:45 P.M.
Al Schutte, Chairman
Zoning Board of Appeals
